1) Scope

1.1 These Terms and Conditions apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur with CLOUVOU GmbH. They also apply to contracts for the delivery of vouchers.
1.2 Consumer within the meaning of these GTC is any natural person who concludes a legal transaction that can predominantly neither be attributed to their commercial nor their independent professional activity.
1.3 Entrepreneur within the meaning of these GTC is a natural or legal person who acts in the exercise of their commercial or independent professional activity.


2) Conclusion of contract

2.1 The product descriptions contained in the online shop do not constitute binding offers but serve to submit a binding offer by the customer.
2.2 The customer can submit their offer via the online order form, by email, contact form, or telephone.
2.3 The seller can accept the offer within five days by:

  • Order confirmation
  • Delivery of goods
  • Payment request
    2.4 Acceptance of the offer by the seller for PayPal payment occurs upon completion of the ordering process.
    2.5 With "Amazon Payments," acceptance occurs with the payment process.
    2.6 The contract text is stored by the seller and sent to the customer after ordering.
    2.7 Before placing the order, input errors can be detected and corrected by correcting the order details.
    2.8 Various languages are available for concluding the contract.
    2.9 Order processing is done via email; the customer is responsible for receiving the emails.

3) Right of withdrawal

Consumers have a right of withdrawal; detailed information can be found in the cancellation policy of the seller.


4) Prices and payment terms

4.1 All prices are total prices including statutory VAT.
4.2 For deliveries outside the EU, additional costs such as customs duties may apply, which are borne by the customer.
4.3 The payment options are specified in the online shop.
4.4 Payment via SOFORT is processed through the service provider SOFORT GmbH.
4.5 For credit card payments via PAYONE, the debit is made at the time of order.
4.6 Credit card payment via secupay or Stripe is made after ordering with immediate due date.
4.7 Payment via "Klarna" is made according to Klarna's terms.


5) Delivery and shipping conditions

5.1 Delivery is made to the address specified by the customer.
5.2 If delivery fails due to the customer's fault, the customer bears the costs.
5.3 Entrepreneurs bear the risk of loss of the goods from the time of handover to the carrier.


6) Retention of title

The seller reserves ownership of the goods until full payment is made.


7) Liability for defects (warranty)

7.1 For new goods, the limitation period for entrepreneurs is one year. For used goods, warranty rights are excluded.
7.2 The liability limitations do not apply to claims for damages or fraudulently concealed defects.
7.3 Entrepreneurs must immediately report transport damages.


8) Special conditions for repair services

8.1 Repair services are carried out at the seller's premises.
8.2 The seller may employ qualified personnel or subcontractors.
8.3 The customer provides all necessary information.


9) Redemption of promotional vouchers

9.1 Promotional vouchers can only be redeemed within the specified period.
9.2 Individual products may be excluded from the promotion.
9.3 Vouchers are non-transferable and will not be paid out in cash.


10) Redemption of gift vouchers

10.1 Gift vouchers can only be redeemed in the online shop.
10.2 Remaining balances will be credited until the expiration date.
10.3 Vouchers cannot be used for other vouchers.


11) Applicable law

German law applies excluding international sales law.


12) Place of jurisdiction

The place of jurisdiction is the seller's registered office if the customer is a merchant.


13) Code of conduct

The seller has submitted to the Trusted Shops quality criteria.


14) Alternative dispute resolution

The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr ready. The seller is not obliged and not willing to participate in a dispute resolution procedure.
